Lakanal Lycée in Paris, the school known as the Kadic prototype, is holding an open day. It will be held on January 24. The French Court of Cassation has ruled that a 2023 decision by the Paris Court of Appeals in a case against the band “The Black Eyed Peas” for plagiarism of the song “Un monde sans danger” was improper. Recall that at that time the case was considered time-barred, since the claims had to be filed up to 5 years after the publication of the contested song. According to the cassation authority, this interpretation of the law is inappropriate. The ruling reads that if the infringement is due to the continuous exploitation of the protected work, each release or commercial use of the work means that the five-year statute of limitations should be counted anew, and not from the date of the premiere release of the work. In 2010, the album “The Beginning,” featured the song “Whenever”, which has some similarities to the series’ opening. Franck Keller and Ygal Amar sent a formal call to the American group about the song in 2011. However, they did not receive a response. The court steps were taken in 2018, when he and Noam Kaniel, who worked on the English version of the song, demanded the amount of $4 million in damages from Fergie and Will.i.am, stating that despite previous messages, the song is still being shared and the US team is still making money from it.
The consequence of the court’s decision is that the case goes to a retrial, but by a different panel of judges. The costs of the proceedings are to be paid by the BMG label, which is also to pay the composers €3,000.
